The petitioners seek bail in connection with Amnour P.S. Case no. 94 of 2015 registered under sections 420 of the Indian Penal Code and section 7 of the Essential Commodities Act.
It is contended that petitioner no. 1 is the President and petitioner no. 2 is Manager of Amnour Kalayan PACS. There is delay of 21 days in instituting the first information report after conducting inspection of the Godown. The petitioners are in custody since 09.09.2015 and the police on completion of investigation have already submitted report under
Patna High Court Cr.Misc. No.52586 of 2015 (5) dt.30-01-2016 section 173(2) of the Code of Criminal Procedure, 1973 in the court. Further contention is that the petitioners having no criminal antecedent are not likely to abscond or tamper with the evidence. Having regard to the facts and circumstances of the case, petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Saran at Chapra in connection with Amnour P.S.
