The petitioner is languishing in custody for the offence punishable under Section 394 of the Indian Penal Code. The FIR relates to an occurrence of robbery of a motorcycle by unknown person.
Submission is that only material against the petitioner is his confessional statement in some other case and the petitioner was remanded in this case on 13.11.2017. He was never put on Test Identification Parade during investigation nor anything was recovered from his possession. Investigation of the case is already complete. Petitioner is ready to cooperate with the trial. Considering the aforesaid fact, let the petitioner,
Patna High Court Cr.Misc. No.20276 of 2018 (2) dt.16-04-2018 P2/ above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Charpokhri P.S. Case No.84 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
