The petitioner is in custody since 20.05.2023 in connection with Daudnagar P.S. Case No. 298 of 2023 registered for the offence punishable under Sections 120(B) of the Indian Penal Code Section 30(a)/32/41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is further submitted that the petitioner is merely a driver of the truck who was having no knowledge about the consignment. It is further submitted that the petitioner has no criminal antecedent. However, the petitioner has offered to deposit Rupees

Patna High Court CR. MISC. No.52081 of 2023(2) dt.23-08-2023 2/2 Fifty Thousand in the charitable organization i.e. Ramkrishna Mission Ashram, Patna.

Learned A.P.P. appearing on behalf of the State vehemently opposed the bail application.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special, Excise Judge II, Aurangabad, in connection with Daudnagar P.S. Case No. 298/2023, subject to the condition that the petitioner will deposit Rs. 50,000/- n the charitable organization i.e. Ramkrishna Mission Ashram, Patna. It is made clear that the bail bond of the petitioner shall be accepted after showing receipt against payment of Rupees Fifty Thousand in the charitable organization i.e. Ramkrishna Mission Ashram, Patna.
