The petitioner apprehends his arrest in Bodhgaya P.S. Case No. 186/2014, registered for the offences punishable under Section 363A of the Indian Penal Code.
The informant alleged that Tulsi Manjhi came and told to send his son to Delhi along with his sons Bigan Manjhi, Kamlesh Manjhi @ Bachana @ Gujrawa Manjhi and Sanjay Manjhi, but the informant refused to send his son, as he is juvenile. After some days, his son was missing. During the course of search Tulsi Manjhi disclosed that his son had gone to Delhi to work and earn livelihood and he would return. It is submitted that there is no evidence against the petitioner that he took son of the informant. The son of the

Similarly situated co-accused Tulsi Manjhi and Bigan Manjhi have already been enlarged on bail. The case of the petitioner stands on similar footing. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No. 186/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
