Petitioner apprehends his arrest in connection with Akbarpur P.S. Case No. 168 of 2012 registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.
It is submitted that in this case co-accused Raushan Kumar @ Raushan has been granted pre-arrest bail vide order dated 2.5.2014 passed in Cr. Misc. No. 50077 of 2013 and as there is no eye witness to the actual occurrence, the petitioner also deserves sympathetic consideration to which the learned APP is not in a position to distinguish the case of the petitioner to that of co-accused.
In the facts and circumstances stated above, the
Patna High Court Cr.Misc. No.30018 of 2014 (2) dt.19-01-2015 petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 168 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
