JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-08-2024 The present writ petition has been filed seeking the following reliefs:- "1.(a) To set aside the entire proceeding of Encroachment Case No. 14/2012-13 with respect to the petitioner land pending before the Circle Officer, Madanpur which has been initiated under Section 6(i) of the Bihar Public Land encroachment Act 1956 with regard to private land of the petitioner pertaining to Khata No. 176, Khesra No. 178 area 0.035

Patna High Court CWJC No.11105 of 2024(2) dt.06-08-2024 2/3 decimal land situated at Madanpur within District-Aurangabad, without having jurisdiction.

(b) To set aside the notice dated 26.06.2024 issued by Circle Officer, Madanpur to the petitioner directing him to remove the encroachment from his private Land while aforesaid land i.e.

Khata No. 176 khesra No. 178 is purchased land of the petitioner vide registered sale deed no. 5345 dated 05.06.2009 and dated 18.08.2005.

(c) For a direction to the respondent authorities to decide Case No. 05/14 which is pending before the District Magistrate-Aurangabad for mutation for the same land and also to dispose of his representation filed by the petitioner against order dated 11.06.2013 in the Encroachment Proceeding Case No.

14/12-2013 against the Circle Officer, Madanpur.

(d) Further for a direction to the respondent authority to stop any action with regard to demolition of construction upon disputed land till the final decision upon this matter by the competent authority."

The learned counsel for the petitioner seeks to withdraw the present writ petition, to which the learned counsel for the respondent-State

Accordingly, the present writ petition stands dismissed as not pressed.
