====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2025 Heard learned counsel for the petitioner and the State. Nobody appears for opposite party no.2 despite valid service of notice.
2. The petitioner seeks regular bail in a case registered for the offence under Sections 366, 366A, 365, 328, 34 of the Indian Penal Code.
3. As per prosecution case, co-accused Umesh Kushwaha kidnapped 18 years old daughter of the informant with intention to marry her.
4. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. The victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has stated that on the instruction of coaccused Umesh Kushwaha, this petitioner took the victim to Godaria. Victim has not alleged any wrong against this petitioner in her aforesaid statement. Said similarly situated coaccused Umesh Kushwaha has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in
Patna High Court CR. MISC. No.50534 of 2025(4) dt.19-12-2025 2/2 Cr.Mis.No. 55326/2024. Charge sheet has already been filed. Petitioner claims clean antecedent and she is in custody since 19.6.2025.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the nature of accusation, materials collected during investigation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge VII cum Special Judge POCSO, Bettiah, West Champaran in Bhitaha Police Station Case No. 30/2024.
