JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pakarideyal P.S. Case No. 40 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 354B, 326A, 326B and 34 of the Indian Penal Code. As per FIR there is allegation against one Rakesh Sah that he threw acid on the daughter of the informant, causing injury to her and thereafter there is general allegation against the petitioner and others and they tried to drag the informant towards market and also assaulted him.

Submission of learned counsel for the petitioner is that he has falsely been implicated as earlier a case of Excise Act has been filed against the informant in which son of petitioner was a witness and no specific allegation has been

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that in view of allegation petitioner does not deserve bail.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Pakarideyal P.S. Case No. 40 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
