JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-08-2019 The petitioner apprehends his arrest in connection with Mansi P.S.Case No. 29 of 2019 registered under Sections 420, 467, 468, 504 and 506/34 of the Indian Penal Code. Allegation against the petitioner, as per FIR, is that informant had gone to join as Secretary, Gram Kutchery and met Sarpanch, Smt. Geeta Devi, but both the Sarpanch and her husband, who is petitioner here, did not allow the informant to join as Secretary, Gram Kutchery and told the informant that confirmation from Block Development Officer did not come. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case based upon misconceived prosecution inasmuch as petitioner is not the competent authority to take joining of the informant and in fact, wife of the petitioner is Sarpanch, who is competent and

Learned counsel further submits that wife of the petitioner i.e. Sarpanch, has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc. No. 38094 of 2019. After having heard learned counsel for the parties and taking into consideration the fact that Sarpanch i.e., wife of the petitioner has been granted anticipatory bail by a co-ordinate Bench of this Court and dispute relating to joining of the petitioner as Secretary, Gram Kutchery, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Mansi P.S.Case No. 29 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
