JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Madhepur P.S. Case No.88 of 2017, a case under Sections 420/409/467/468 of the Indian Penal Code.

Allegation against the petitioner is that when he was posted as Najir he did not deposit in the Government account the revenue collected.

Submission of the learned counsel for the petitioner is that the F.I.R. would itself reveal that on 19.09.2017 the petitioner had given in writing that he was busy in preparation of bill in the matter of flood relief scheme. As such, the cash book was not updated. However, on 03.10.2017 itself F.I.R. has been

The Circle Officer has granted certificate vide Annexure-2 that seven lacs three thousand six hundred and odd has been deposited and, hence, no dues stands against the petitioner. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
