The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act.

It is contended that, as per allegation, 16.50 liters of foreign liquor was recovered from the possession of the petitioner. It is further contended that the petitioner has been made accused in another case, i.e., Alamganj P.S. Case No. 202/2010 under sections 379/461 of the Indian Penal Code. It is urged that the petitioner is in custody since 19.12.2017.

No.22821 of 2018(2) dt.19-04-2018 2/2 Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Patna in connection with Alamganj P.S. Case No. 496 of 2017 (Special Case no 9360 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
