JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,452,504,506 and 380 of the Indian Penal Code and section 3(1)(iv)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the petitioners and Md. Alam were laying foundation of the house at the behest of co accused Jairam Yadav and on protest being made Md. Alam abused the informant by calling the caste name and threatened. Md. Alam and co accused Jairam were seen is suspicious condition and subsequently theft was committed.
Patna High Court Cr.Misc. No.1635 of 2016 (2) dt.13-01-2016 2/2 It is submitted by the learned counsel for the petitioners that the thrust of accusation is against Md. Alam and the accusation has been levelled in the background of land dispute. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation in the background of serious land dispute and for the occurrence of 16.4.2015 to 17.4.2015 FIR was registered on 24.4.2015, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Munger in connection with SC/ ST P.S. Case No.12 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
