JUSTICE ARUN KUMAR ORAL ORDER 08-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Fulkaha PS Case No. 121 of 2017 registered under Sections 272 and 273/34 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act. The allegation in brief is that 105 litres of Nepali liquor was recovered being carried by the petitioner on motorcycle. Learned Counsel for the petitioner submits that the petitioner is a porter, the real persons are behind who are engaged in sale and purchase of liquor and the petitioner has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Sanjit Kumar Mandal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge (Excise) Araria in connection with Fulkaha PS Case No. 121 of 2017.
