Petitioner who is in custody seeks bail in a case registered for the offence punishable under Sections 272, 273, 420, 120(B) and 414 of the Indian Penal Code and under Section 30(a), 41 of the Bihar Prohibition and Excise Act, 2016. Informant in his written report has alleged that on 27.12.2019 at about 2:30 hours on getting confidential information regarding unloading of wine from a truck, a raid was conducted and during course thereof, all the persons present since before managed to escape while the petitioner was apprehended. Furthermore, two pick-up vans and a truck was found there. There happens to be independent disclosure regarding recovery of items including wine and so far the petitioner is concerned, it has been alleged that he happens to be

Patna High Court CR. MISC. No. 5639 of 2021(2) dt.12-04-2021 2/3 the owner cum driver of the pick-up van bearing Registration No.BR-06GA-4333 wherefrom 475 litres of foreign wine (Indian origin) were seized.

It has been submitted on behalf of the petitioner that the name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Arun Kumar who has already been granted bail by a co-ordinate bench of this Court vide order dated 28.02.2020 in Criminal Miscellaneous No. 9277 of 2020. Similarly, situated co-accused Hemant Kumar Singh has also been granted bail by a co-ordinate bench of this Court vide order dated 14.08.2020 passed in Criminal Miscellaneous No. 22084 of 2020. Petitioner is in custody since 17.09.2020.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Minapur P.S. Case No. 629 of 2019, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his/her absence on two consecutive dates without
