JUSTICE SHIVAJI PANDEY ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Narhat P.S. Case No. 55 of 2015 registered for offences under Sections 341, 323, 448, 504, 376, 511, 354B and 506/34 of the Indian Penal Code.

It appears that on 16.04.2015 at 6 o'clock while the informant was scavenging her Verandah, Jitendra Kumar, Giri Kumar and Pankaj Kumar (Petitioner) tried to outrage her modesty. The informant started raising hulla, upon which the daughter of Pankaj Kumar (Petitioner) came there and started to save her and thereafter, she became senseless. In the meantime, other persons came and she could be saved.

No.49973 of 2015 (2) dt.09-11-2015 2/2 The counsel for the petitioner submits that the story that has been narrated by the victim lady, is completely unnatural as it is improbable to ravish a lady in presence of her daughter. Looking to the facts and circumstances of the case, let the petitioner Pankaj Kumar, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Nawada in connection with Narhat P.S. Case No. 55 of 2015.
