2. The petitioner seeks bail in Patarghat P.S. Case No. 51 of 2024 registered for the offence punishable under Sections25(1-B)a, 26 of the Arms Act.

3. It is alleged that two rifles, ten empty cartridges and two live cartridges were found kept in the box and the same were recovered from the house of the petitioner.

4. Learned Sr. Counsel appearing for the petitioner has submitted that the petitioner is a person of clean antecedent and the arms and ammunitions were not recovered from conscious possession of the petitioner rather the same was recovered from joint house of the petitioner. He is in custody

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Patarghat P.S. Case No. 51 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.

7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any case other than the present one, his bail bonds shall not be accepted.
