JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504 and 506/34 of the Indian Penal Code. The prosecution case is that the petitioner and co accused Ashok Singh and Nawal Kishore Singh were capturing the land of the informant, on protest being made the informant was assaulted.

It is submitted by the learned counsel for the petitioner that only two injuries have been found by the doctor; one is complain of backache and complain of headache. The injury on the head has been found to be grievous whereas the backache has been found to be simple.

Patna High Court Cr.Misc. No.4715 of 2016 (2) dt.04-02-2016 2/2 submitted that in the background of land dispute the accusation has been levelled. There is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the genesis of the occurrence and there is counter version of the occurrence, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari in connection with Palanwa P.S. Case No.83 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
