JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offences punishable under Sections 302/34/120B of the Indian Penal Code.

The FIR was lodged by the local Chaukidar on recovery of dead body with allegation in the FIR that the wife of the deceased alongwith her criminal associates have committed murder of the deceased. Name of the petitioner surfaced in the confessional statement of co-accused Deepak Kumar Mehta. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.21648 of 2018 (2) dt.18-04-2018 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Falka P.S. Case No.359 of 2017, with condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
