The petitioner is languishing in jail since 02.04.2015 in a case instituted under Sections 324 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
As per allegation, it is a case of assault on the informant which hit on the stomach and arms.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.04.2015. Chargesheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. Petitioner has been made accused due to mistake of fact. No motive has been alleged against the petitioner for committing the alleged offence. Out of three
Patna High Court Cr.Misc. No.38989 of 2015 (3) dt.08-10-2015 injuries two are on non-vital parts of the body. It is further submitted that the petitioner may be released after completion of nine months from 02.04.2015.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, it is directed that the above named petitioner may be released on bail after completion of nine months in custody from 02.04.2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Mohania P.S.Case No.102 of 2015.
