JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2016 These applications for grant of anticipatory bail arise out of Kadamkuan P.S. Case No. 365/2015, disclosing offences under sections 406, 420, 419, 467, 468, 471, 120B of the Indian penal Code.

The petitioner of Cr.Misc.No. 3604/2016 is the wife of the petitioner in Cr.Misc.No. 2645/2016. Allegedly, the informant had given an amount of Rs.80,000/- to Rakesh Roushan on a false assurance that he would get her admitted in B.Ed. course.

Patna High Court Cr.Misc. No.3604 of 2016 (3) dt.04-03-2016 Learned counsel for the petitioners submits that the parties are intending to get the dispute resolved outside the Court. Considering the facts and circumstances and the submissions as advanced on behalf of the petitioners, these applications are allowed.

Let the petitioners, abovenamed, in the event of their arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Kadamkuan P.S.Case No. 365/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/ court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.

It will be open to the informant to apply for cancellation of bail granted to the petitioners by virtue of the present order, if the dispute between the parties is not finally settled. (Chakradhari Sharan Singh, J) Surendra/- U
