JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Bettiah Town P.S. Case No. 207 of 2013 registered for the offences punishable under Sections 147, 148, 447 and 504 of the Indian Penal Code read with Sections 25(1-B) & 27 of the Arms Act and Section 3/4 of the Explosives Substances Act, seek the privilege of pre-arrest bail.

Allegedly, the petitioners and other F.I.R. named accused persons along with 20-25 unknown opened fire upon the house of the informant, exploded bomb and they were having

Patna High Court Cr.Misc. No.30814 of 2014 (3) dt.22-01-2015 Bhala, Gandasa and Lathi and they abused the informant and his family members.

Submission is that petitioner no. 2 has also lodged case bearing Bettiah Town P.S. Case No. 337 of 2012 against the informant and others and then the informant has lodged this case after concocting the story.

Considering that the petitioner no. 2 has lodged case earlier against the informant and others and further considering that no injury or damage has been caused and as such, the petitioners, in case of their arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 207 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
