JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sadar P.S.Case No. 500 of 2017 registered under Sections 302/201 of the Indian penal Code.
Petitioner is the informant of the case and she stated that her husband went missing since 11.09.2017 and dead body was recovered on 13.09.2017 from a bush when the case was lodged by her.
Learned counsel for the petitioner submits that petitioner is made accused on the basis of a confessional statement and at best only a case under Section 201 I.P.C. is made out and the allegation of killing is against her paramour, another co-accused. Whereas learned counsel for the State submits that she is the main conspirator and in collusion with her paramour, she got her
Patna High Court Cr.Misc. No.6395 of 2018 (4) dt.14-03-2018 2/2 husband killed and she did not informed anywhere regarding missing of her husband.
Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial.
