Without adverting to the merit of the case, as has been submitted by learned Additional Public Prosecutor that examination of all the prosecution witnesses have already been concluded, instant petition is disposed of with a direction to the learned lower court that in case there happens to be proper cooperation at the end of petitioner, the trial be concluded within eight weeks.

In pursuance of order dated 07.10.2015 additional/supplementary show cause has been filed on behalf of Superintendent of Police, Siwan who is physically present in court. Heard learned Additional Public Prosecutor.

After going through the additional/supplementary show cause, it is evident that the Superintendent of Police, Siwan himself admitted some sort of slackness at his part and for that has posed his

Patna High Court Cr.Misc. No.17989 of 2015 (7) dt.09-10-2015 2/2 subordinate as an scapegoat. Such kind of conduct is deprecated. It happens to be responsibility of the Superintendent of Police to have inquired about compliance report at least relating to an order passed by this Court. However, as unconditional apology has been sought for on account thereof, the matter is being closed with a warning that the Superintendent of Police should be vigilant and attentive in future towards compliance of the court's order. Subsequent failure at his part will be viewed seriously.
