====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 28-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Saharsa Cyber P.S. Case No. 33 of 2024 dated 12.05.2024 registered for the offences punishable under Sections 406, 419, 420, 465, 467, 468, 471, 120B of the I.P.C., Sections 66, 66C, 66D of the I.T. Act and Section 3⁄4 of the Public Gambling Act.

3. As per the prosecution case, police arrested five persons including the petitioner and on search, one Laptop, one Tab and different articles were recovered from the bag of the petitioner and different articles were also recovered from the other co-accused persons. It is further submitted that all the accused persons were involved in cyber crime and used to cheat

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. No incriminating article has been recovered from his possession. It is further submitted that whatever the articles alleged to have been recovered by the police which belongs to the petitioner and his family members. It is further submitted that no one has made complaint against the petitioner with regard to any alleged crime or transaction which clearly falsifies the prosecution case. There is no specific allegation against the petitioner. He has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 13.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.

The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
