JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-12-2024 The learned counsel for the opposite parties submits that in compliance of the order of this Court dated 16.5.2024, passed in CWJC No. 8166 of 2024, a measurement was conducted by a team of three Amins, pertaining to the land in question in presence of the villagers and the petitioner, whereupon it was found that a pond has been constructed after taking NOC from the concerned Gram Panchayat and a path ad-measuring 18x 25 feet is existing towards north of the said pond, hence, there is no obstruction to ingress and engress of general public at large. It is also pointed out that the earlier report, to the aforesaid effect, was endorsed by the petitioner by putting his signature. 2.

The learned counsel for the petitioner submits that the

Patna High Court MJC No.2324 of 2024(5) dt.20-12-2024 2/2 petitioner may be granted liberty to approach the Respondent authorities in case the path in question is obstructed in future. Liberty, so sought, is granted.

Accordingly, the present contempt petition stands disposed off on the aforesaid terms.
