Petitioner, already in custody, seeks bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No.574 of 2017, registered under Sections 302/34/120(B) of the Indian Penal Code.

Allegation in brief is that the deceased was called by Amit Kumar, one of the accused, and got him to the house of Vikky Kumar where Rambabu Sah assaulted him with sharp edged weapon on the chest and Tripurari Kumar, Maharaja Kumar also assaulted with sharp edged weapon along with Golu Kumar and this petitioner is said to have given an iron rod blow. Learned counsel for the petitioner submits that the

No.14648 of 2018(2) dt.15-03-2018 2/2 petitioner is attributed with assaulting the deceased by iron rod but no such corresponding injury is found on the deceased, out of six injuries, one is stabbed wound and rest are incised wounds attributed to other accused armed with sharp edged weapon, the petitioner has no criminal antecedent and he is in custody since 26.08.2017.

Having considered the said facts and circumstances, petitioner Abhishek Patel is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bettiah, District West Champaran in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No.574 of 2017.
