The petitioner in this case seeks regular bail in connection with Saraia P.S. Case No. 262/2022 for the offences punishable under Sections 392 and 411 of the I.P.C. As per the prosecution case, some miscreants overpowered the informant on gun point and taken away his pickup Van loaded with plywood from the way which was recovered by police and three accused persons including the petitioner were arrested and one accused fled away. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.49503 of 2022(2) dt.13-12-2022 2/2 petitioner was not involved in the occurrence and he has been falsely implicated in this case. Chargesheet has already been submitted in this case. It is further submitted that the petitioner is in jail custody since 02.05.2022 for his no fault and he has no criminal antecedent and he is a student.
Learned APP for State opposed the regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, (West) Muzaffarpur in connection with Saraia P.S. Case No. 262/2022.
