JUSTICE JYOTI SARAN ORAL ORDER 14-01-2015 Heard Mr. Suraj Narain Prasad Sinha, learned senior counsel for the petitioner and the State.

The petitioner apprehends his arrest in connection with Nawanagar (Basudewan O.P.) P.S. Case No. 14 of 2014 registered for offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Mr. Sinha, learned senior counsel appearing on behalf of the petitioner with reference to the allegation made in the FIR submits that although a raid was conducted on the request of the Circle Officer alongwith the Officer-in-Charge, Nawanagar on getting information that a huge crowd was standing for obtaining information from the Right to Public Services Counter set up under the provisions of the Right to Public Services Act for

No.30574 of 2014 (2) dt.14-01-2015 obtaining residential certificate etc. and on seeing the police, the crowd dispersed while two persons were apprehended including a staff of this petitioner who runs a photo stat shop within the premises but even in absence of any allegation against this petitioner of any alleged violation or being involved in any illegal activity, that his name has transpired during the course of investigation as being the owner of the photo stat shop. Having heard learned counsel for the parties and taking note of nature of allegation, let the petitioner Sunil Kumar in the event of his arrest or surrender within four weeks from today be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Nawanagar (Basudewan O.P.) P.S. Case No. 14 of 2014 subject to the stipulations laid down under Section 438(2) of the Code of Criminal Procedures.
