SONI SHRIVASTAVA ORAL ORDER 25-07-2025 In view of defect no.6 (1), learned counsel for the petitioner submits that the explanation with regard to criminal antecedent of the petitioner has already been given in para-2 of the bail application.
2. Defect no.6 (1) is ignored.
3. Heard learned counsel for the petitioner and learned APP for the State.
4. The petitioner apprehends her arrest for the offences punishable under Sections 329 (3), 126 (2), 115 (2), 110, 119 (1), 324 (4), 303 (2), 308 (3), 352, 3, 51 (2)/3(5) of the B.N.S.
5. The prosecution case in the F.I.R. is that the accused persons including the present petitioner came at the place of occurrence and caused damage to buildings and, upon
Patna High Court CR. MISC. No.50471 of 2025(2) dt.25-07-2025 2/3 protest being made, they abused one Raj Mistri and also demanded Rs.10 lacs from the informant. Further allegation is that they put some paddy bundles in the field of the informant and upon objection raised to the same, one Manish Sah and Surendra Kamat assaulted the son of the informant on his neck.

Learned counsel for the petitioner submits that it would be evident from the first information report itself that there is general and omnibus allegation as against this petitioner being a part of the group which was trying to damage the house of the informant. However, it would be clear that a specific allegation of assault and asking extortion is upon Manish Sah and Surendra Kamat. There is no specific allegation on this petitioner. Sanjiv Kumar Bharti has also not sustained any injury, which would be evident from the order dated 29.05.2025 passed in Cr. Misc. No.30463 of 2025 (Annexure-P/5), which is an order granting regular bail to co-accused, Manish Kumar. It is next submitted that the petitioner is a widow lady aged about 59 years and is not involved in any act of assault etc.
7. Taking into consideration the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today,

No.50471 of 2025(2) dt.25-07-2025 3/3 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court in connection with Khutauna P.S. Case No.169 of 2024, subject to the condition as laid down under Section 482 (2) of the B.N.S.S.
