Mr. Arun Kumar Bhagat, learned A.C. to AAG 12 is present and submits that although the writ petition was filed questioning the initiation of departmental proceedings along with the suspension order but during the pendency of the writ petition, final orders have been passed in the departmental proceedings whereby the petitioner has been dismissed from service. He submits that the order of dismissal dated 25.1.2016 has been placed on record vide Annexure-21 to I.A.No.736 of 2016 filed to amend the writ petition. Considering the submissions advanced by learned counsel and taking note of the fact that the departmental proceedings so questioned has reached its conclusion in the order dated 25.1.2016 impugned at Annexure-21 to I.A. No. 736 of 2016, the writ petition is
Patna High Court CWJC No.1161 of 2016 dt.17-09-2016 disposed of with liberty to the petitioner to exhaust the alternative remedy of appeal so available to him to question the order of termination.
The writ petition and the interlocutory application are disposed of.
