====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-09-2022 Heard learned counsel for the petitioner.

Considering that the relationship of the petitioner and the sole opposite party being husband and wife is not in dispute and that the learned court below having noticed that the wife has no independent source of income whereas the materials have come on record showing that the husband is working in a private factory at Katihar, awarded a sum of Rs.3500/- per month only towards maintenance and the amount so awarded is a meagre amount in the present day's economic condition and price index of the country, this Court is not inclined to interfere with the impugned judgment.

This application is dismissed.

Patna High Court CR. REV. No.912 of 2019(3) dt.15-09-2022 2/2 If the petitioner has not paid the maintenance amount so far, the same will be realized together with a cost of Rs.25,000/- payable by the petitioner to his wife with arrears of maintenance.

Let it be recorded that the maintenance case was filed in the year 2014 and non-payment of maintenance for more than eight years is a serious matter, thus, while rejecting this application, this Court thinks it just and proper to impose a cost of Rs.25,000/-.
