2. The petitioner seeks bail in Katoria Excise P.S. Case No. 94 of 2024 registered under Section-30(a) of the Bihar Prohibition and Excise Act, 2016.

3. The prosecution case, in short, is that in course of checking of vehicles, the petitioner was arrested with a vehicle and on search of the said vehicle, 214.14 litres wine is said to have been recovered.

4. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-06-2024. It is

Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner had no knowledge regarding the alleged incident. The petitioner is in custody since 26-06-2024.

5. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

6. Considering the aforesaid facts and circumstances, specially the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V-cum-Special Judge, Exclusive Excise Court No.-2, Banka in connection with Katoria Excise P.S. Case No. 94 of 2024.
