In this case, the petitioners are seeking bail in connection with Pandaul P.S. Case No. 163 of 2015 registered for offences under sections 506/504/341/323/324/307/34 of the Indian Penal Code. The petitioners are in custody since 05.08.2015. Allegation has been made by the informant that a dispute arose on account of placing cow dung. Both the sides have assaulted each other. As per the allegation, the petitioner No. 1 has caused injury by Farsa and petitioner No. 2 has also caused injury by Farsa. It was case a case of free fight. Both the sides have received injuries.
Patna High Court Cr.Misc. No.49734 of 2015 (2) dt.06-11-2015 P2/2 Looking to the facts and circumstances of the case, let the petitioners abovenamed, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 163 of 2015, subject to the condition that (i) one of the bailors shall be a close relative of the petitioners (ii) if the petitioners are found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of their bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioners would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
