2. The petitioner has preferred this application for grant of regular bail in connection with Sajour P.S. Case No. 01 of 2024 dated 04.03.2024 registered for the offences punishable under sections 302/120B and 34 of the Indian Penal Code & section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is alleged to have committed murder of the informant's son Mithilesh Kumar @ Mithun Kumar with the help of unknown miscreants under conspiracy.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.53307 of 2024(3) dt.12-09-2024 2/3 that the petitioner is innocent and has falsely been implicated in this case. It has further submitted that the charge-sheet has already been submitted against the petitioner. The petitioner had illicit relationship with the wife of the deceased. The name of the petitioner has transpired in this case on mere suspicion. The petitioner has no concern with the alleged occurrence. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.03.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the petitioner had illicit relationship with the wife of the deceased and due to that the petitioner hired some criminals to cause the death of the deceased for which he had paid Rs. 40,000/- to the miscreants. The C.D.R. records indicate that the mobiles location of the petitioner and the co-accused persons were found near the place of occurrence at the date of the incident.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Sajour
