The petitioners, being brothers and parents of the husband of the informant, are apprehending arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The prosecution case is that the informant was married with Dilip Bind four years prior to lodging of the present case, though for one year, the informant was kept with full dignity and honour, but thereafter, further dowry demand of a
Patna High Court CR. MISC. No.48073 of 2019(2) dt.01-08-2019 2/3 motorcycle and a gold chain was made and due to nonfulfillment of the same, torture was inflicted upon the informant. Ultimately, the informant was driven out from the matrimonial house after snatching her all jewellery and belongings. It is submitted by learned counsel for the petitioners that the thrust of accusation is against the husband of the informant and the petitioners claim to be reside separately from the husband of the informant. Moreover, the accusation of demanding further dowry after four years of marriage appears to be unreasonable.
It is submitted by learned counsel for the informant that the accusation of torture has also been levelled against the petitioners and due their connivance, the informant could not be allowed to lead peaceful matrimonial life.
Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Kaimur at Bhabua in connection with Bhabua Mahila P.S. Case No.28 of 2019,
