JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,143,323,504,379,386 and 387/34 of the Indian Penal Code. It is alleged that the petitioners along with 3-4 unknown snatched five thousand rupees of the informant and demanded extortion of rupees fifty thousand.
It is submitted by the learned counsel for the petitioners that petitioner no. 1 lodged a case against the informant for carrying oxen for butchery purposes on 21.11.2015 at 1 P.M. when the present FIR was registered on 21.11.2015 at 1.40 P.M.
Patna High Court Cr.Misc. No.4240 of 2016 (2) dt.30-01-2016 2/2 Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the case lodged by petitioners side at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Sadar P.S. Case No.618 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
