JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-12-2017 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.
Mr. Pankaj Kumar Singh, appearing on behalf of the petitioners submits that earlier the petitioners have filed representation before the respondents but the same was not disposed of by respondents.
He submits that he may be permitted to file a fresh representation before the respondent no.3, Director Primary Education and the Director Primary Education may be directed to consider the representation of the petitioners objectively and
8/8 dispose of the same by a reasoned speaking order. Counsel for the State has no objection in filing representation on behalf of the petitioners.
Considering the prayer made by the petitioners, the petitioners are permitted to file representation before the Director, Primary Education within a period of 15 days from today alongwith a copy of this order. In case, such representation is filed on behalf of the petitioners alongwith a copy of this order, the Director, Primary Education will consider the representation and dispose of the same by a speaking order within a period of 60 days from the date of filing of such representation. It is made clear that this court has not expressed any opinion on the merit of the claim of the petitioner. With the aforesaid observation, the application stands disposed of.
