JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Jogapatti (Nawalpur) P.S.Case No. 331 of 2017 registered under Sections 147, 148, 149, 302, 307, 341, 323, 324, 447 and 448 of the Indian penal Code.

Allegation in brief is that accused persons came to the house of the informant Md. Akhtar and Allauddin Ansari assaulted with lathi and iron rod over the head of the informant's father. It is alleged that when informant went to rescue his father, then these two petitioners tried to strangulate by putting rope around his neck.

Submission is that allegation of assault to the deceased is not against the petitioners rather against Allauddin Ansari and

Patna High Court Cr.Misc. No.8359 of 2018 (2) dt.13-02-2018 2/2 Jallabuddin Ansari and injury caused on the person of the informant is simple in nature and there is case and counter case between both sides and charge sheet has been submitted against the petitioners.

Having considered the aforesaid facts and circumstances, the petitioners, namely, Masoom Ansari @ Fanna Ansari and Afzal Ansari @ Gori Ansari, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM, West Champaran at Bettiah in connection with Jogapatti (Nawalpur) P.S. Case No. 331 of 2017.
