In this application for anticipatory bail the petitioner apprehends his arrest for the offence punishable under sections 409, 420, 468 and 34 of the I.P.C.

Allegedly, the petitioner being Mukhiya diverted the fund meant for PCC and brick soling to Solar light purchasing. Submission is that the petitioner acted as per the discussions made in the meeting of villagers. He has no any personal interest. It is not a case of misappropriation of Government money. The petitioner thought that when fund will come for purchase of Solar light then from that fund PCC and brick soling work will be done. The learned A.P.P. opposes the

Patna High Court Cr.Misc. No.30913 of 2014 (2) dt.27-01-2015 2/2 prayer for bail.

Considering the submission urged at the bar, going through the records and noticing that there is no allegation that the petitioner has misappropriated the Government fund and as such the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Bhojpur at Ara in Charpokhari P.S. Case No. 268 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
