JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Kuchaikote P.S. Case No. 55 of 2019, disclosing offences under Sections 341, 323, 324, 307, 379, 384, 385, 427, 504, 506 and 34 of IPC.

As per F.I.R. it is alleged that petitioner no.1 used to take meal on the line hotel of the informant and not paying the amount and on the date of occurrence, they came and demanded Rangdari and abused to the informant and also destroyed the articles of the hotel. It is also alleged that when the father of the informant came to save his son, petitioners and two other accused persons tried to tied the towel around the neck in order to kill him.

Submission of the learned counsel for the petitioners is that injuries does not appear to be serious in nature. They

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that informant and his father has received injuries on their person, which appears from the impugned order.

Having heard both sides, in view of the allegations, so far as, petitioner no.1 is concerned, I am not inclined to grant privilege of anticipatory bail to the petitioner no.1. So far as, petitioner no.2 is concerned, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikot P.S. Case No. 55 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
