ANJANA MISHRA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Charpokari P.S. Case No.268/13 registered for the offences under Sections 409, 420 and 468/34 of the I.P.C.

It is submitted on behalf of the petitioner that he is the Panchayat Sewak in Babubandh Panchayat and allegation against him is that in the financial year 2010-2011 under the scheme 28 solar lights were purchased instead of purchasing five solar lights which are supposed to have been sanctioned. It is further submitted by the petitioner that he is merely a Panchayat Sewak and the Secretary and the Mukhyiya of the Gram Panchayat holding higher posts are responsible for making

Patna High Court Cr.Misc. No.30997 of 2014 (2) dt.20-01-2015 2/2 purchase. It is further submitted that the Panchayat Secretary, namely, Satya Narayan Rai has also been extended the privilege of anticipatory bail vide order dated 31.7.2014 passed in Cr.Misc. no.32032/14.

Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within two weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Bhojpur,Ara, in Charpokhari P.S. Case No.268/13 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Anjana Mishra, J) AnilKrSinha/- U T
