JUSTICE JYOTI SARAN ORAL ORDER 10-11-2015 Heard Mr. Narbadeshwar Prasad Singh, learned counsel appearing for the petitioners and learned counsel for the State.
The petitioners are in custody in connection with Dumara P.S. Case No.211 of 2015 registered for the offences punishable under sections 406, 467, 468, and 471/34 of the Indian Penal Code.
Learned counsel appearing for the petitioners with reference to the allegations made in the FIR submits that merely on suspicion and presumption that these two petitioners have been charged in getting someone else to impersonate them in the competitive examination held for selection of constables. He submits that even though the handwritings and the
Patna High Court Cr.Misc. No.50584 of 2015 (2) dt.10-11-2015 signatures of these petitioners have been doubted but these are mere opinion of the selection committee without certification by an expert body. He further submits that the petitioners have not only lost selection but they have remained in custody since 4.9.2015 and have clean antecedent.
Having heard learned counsel for the parties and considering the submissions so advanced let the petitioners, namely, Deepak Raj and Govinda Kumar be released on bail upon each of them furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi at Sitamrhi in connection with Dumara P.S. Case No.211 of 2015.
