ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.08.2017 on his remand in connection with Aurai P.S. Case No.63 of 2016 registered for the offences under Sections 385 and 387 of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the petitioner came in the confessional statement made before the police by one Manish Kumar, which has no evidentiary value. He further submits that no incriminating article has been recovered from the possession of the petitioner nor he has been put on T.I. Parade.
Considering the entire facts and circumstances of the
Patna High Court Cr.Misc. No.5494 of 2018 (2) dt.01-02-2018 2/2 case and that the petitioner's name has surfaced only on the basis of the confessional statement made by co-accused before the police, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-13th-Cum-SubJudge, 14th, Muzaffarpur, in connection with Aurai P.S. Case No.63 of 2016.
