The petitioner has preferred this application for grant of regular bail in a case registered under section 307 of the Indian Penal Code and sections 25(1-B)(a), 26 and 27 of the Arms Act. As per the prosecution case, in an attempt by four named accused persons to loot petrol pump, it is stated that one of the accused namely Bajrangi Sah was caught and on his statement the name of the three other accused persons including the petitioner herein transpired.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The only material against the petitioner is the statement of the coaccused made before the police. No incriminating article has been recovered from petitioner's possession. He is in custody since 17.1.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Jale P.S. Case no.11 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Darbhanga.
