The petitioner seeks bail in connection with Barachatti (Mohanpur) P.S. Case no. 762 of 2017 registered under Section 30(D) of Bihar Excise Prohibition Act-2016.

750 Kg. Mahua is said to have been recovered from the bamboo cluster standing besides the cabin of the machine of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemies. He has no concern either with the place of recovery or with the seized Mahua. He has no

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Barachatti (Mohanpur) P.S. Case no. 762 of 2017.
