JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-08-2021 Heard Mr. Sabal Kumar Jha, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Mahnar P.S. Case No. 269 of 2020, dated 28.08.2020, instituted for the offences under Sections 341, 354, 354(B) and 34 of the Indian Penal Code and Section 11 of the Protection of Children from Sexual Offences Act, 2012.

Patna High Court CR. MISC. No.5028 of 2021(2) dt.06-08-2021 2/3 The petitioner along with his friend, viz., Raju is said to have caught a young girl with an intention to molest her. The friend of the petitioner was apprehended by the villagers and handed over to the police. The petitioner could anyhow manage to run away.

It has been urged on behalf of the petitioner that the victim and the petitioner are students and neighbours. The case has been compounded as well.

From a reading of the F.I.R., it appears that the petitioner and his associate had the temerity to indulge in such kind of an act with a co-villager and a neighbour. That the associate of the petitioner was apprehended by the members of the public and handed over to the police indicates that there is no false implication in this case. The very fact that a compounding petition has been filed, further indicates that the petitioner and his associate are exerting undue pressure on the informant for settling the case.

This Court is not inclined to grant anticipatory bail to the petitioner.

The application stands dismissed.
