The petitioner seeks bail in connection with Paru P.S. Case No. 167 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 74, 117(2), 326(g), 118(1), 352, 351(2), 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

Prosecution case in a nutshell is that a land dispute led to a violent attack on the informant's brother by Dinesh Ray and others on 01.04.2025. The accused assaulted informant's brother and others with weapons, causing serious injuries including a fractured hand. It is further alleged that the accused later set fire to the informant's house while he was attending to the injured.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21-05-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From bare perusal of the FIR, it would reveal that petitioner allegedly was caught holding injured - Shailendra Roy, thereafter, co-accused, namely, Vikram Roy assaulted him by iron rod as a result, his right hand allegedly got fractured. There is case and counter case between the parties. Referring to the impugned order, it is pertinently submitted that injury is found to be simple in nature. There is no specific allegation of assault against the petitioner.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no allegation of assault against the petitioner and injury being found to be simple in nature, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Paru P.S. Case No. 167 of 2025.
