The petitioner seeks bail in connection with Mufassil P.S. Case No. 408 of 2020, dated 13.08.2020, instituted for the offences under Section 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

By the road-side, 39.65 litres of liquor was recovered.

No.59920 of 2021(2) dt.23-05-2022 2/2 The petitioner was not apprehended from the spot but is sought to be prosecuted in this case on the presumption that the liquor so seized was brought by him. The petitioner is in custody since 13.08.2021. It has been submitted on behalf of the petitioner that only because of his involvement in earlier cases of similar nature, he has been made accused in this case as well.

Considering the period of custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-II-Cum-Special Judge, Excise Act, Begusarai in connection with Mufassil P.S. Case No. 408 of 2020. The application stands allowed.
