The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 420/34 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act.

It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. It is also submitted that petitioners are languishing in judicial custody since 17.06.2022. It is further submitted that in the entire F.I.R., the time of occurrence has not been mentioned, so it is dubious to pertain the time of frisking. It is also submitted that seizure list was prepared after the examination. Petitioners were not caught in using unfair means or cheating. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and
Patna High Court CR. MISC. No.49639 of 2022(4) dt.01-02-2023 3/3 circumstances of the case, this Court is inclined to enlarge the petitioners on bail.
