The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 436/504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that though there is allegation that the petitioner has set on fire the shops in questions, but on inspection of the place of occurrence, nothing has been found to have been burnt and there is no further material in the case diary to substantiate the said charge. He submits that entire case is false and fabricated and occasioned on account of the fact that the petitioner and the informant were having a history of land dispute.

No.4524 of 2016 (3) dt.22-04-2016 P2/2 Considering the aforementioned facts and circumstances of the case and also there is no further cogent material in the case diary to connect this petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 3rd, Samastipur in connection with Khanpur P.S. Case No. 140/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
